11. Digital Millennium Copyright Act (DMCA) Notice
Allied Forensic Accounting PLLC respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (the "DMCA"), we have implemented procedures for receiving written notification of claimed copyright infringement and for processing such claims in accordance with the DMCA and other applicable law.
11.1 Reporting Copyright Infringement
If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on this Website, please notify our designated copyright agent in writing. Your notification must include substantially the following information:
A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material. Providing URLs in the body of an email is the best way to help us locate content quickly.
Information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
11.2 Designated Copyright Agent
Our designated copyright agent to receive notifications of claimed infringement can be reached at the following address:
Name of Designated Agent: Julian Dozier
Address: PO Box 16344, Tallahassee, Florida 32317
Email Address: JDozier@TestifyingCPA.com
Please note that if you knowingly misrepresent that material or activity is infringing your copyright, you may be held liable for damages under Section 512(f) of the DMCA.
11.3 Counter-Notification
If you believe that material you posted on the Website was removed or access to it was disabled as a result of a mistake or misidentification, you may file a counter-notification with our designated copyright agent. Such counter-notification must contain substantially the following information:
Your physical or electronic signature.
Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled. Providing URLs in the body of an email is the best way to help us locate the content quickly.
A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if your address is outside of the United States, for any judicial district in which the service provider may be found), and that you will accept service of process from the person who provided notification under subsection (c)(1)(C) or an agent of such person.
Upon receipt of a valid counter-notification, we may send a copy of the counter-notification to the original complaining party informing that party that we may reinstate the removed material or cease disabling access to it in 10 business days. Unless the copyright owner files an action seeking a court order against the content provider, member, or user, the removed material may be reinstated, or access to it restored, in 10 to 14 business days or more after receipt of the counter-notification, at our sole discretion.
Allied Forensic Accounting PLLC reserves the right to remove any content alleged to be infringing without prior notice, at our sole discretion, and without liability to you.
